Don’t be confused!
The financial obligations for provision of infrastructure in Clarksburg – obligations that are the developer’s responsibility in accordance with standard development approvals – will be transferred to YOU, the Clarksburg taxpayer, if the County Council fails to take corrective action on Clarksburg Development Districts.
           
The CTCAC Report exposes Clarksburg Development Districts as legally flawed and highlights the illegal actions taken at every significant step in the process of Clarksburg Development District implementation.  

 

Why would the developers be required to fund infrastructure?

As a matter of public policy, Montgomery County development laws require developers to shoulder a portion of the financial burden for infrastructure associated with any new development

The developer infrastructure obligations are even greater when associated with higher-density development.

In response to anticipated high-density development in Clarksburg, the Master Plan required increased developer contributions (above and beyond those obligations incurred through the standard development approval process).

Development Districts were one possible source of additional funding for infrastructure in Clarksburg, but, the decision to use Development Districts had to be made, and any such districts to be implemented, prior to development approvals (in accordance with the requirements of the Master Plan). Clarksburg Development Districts did NOT meet this requirement.
